1. Acceptance of Terms

By accessing or using MyComicGift (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of the Service

MyComicGift provides AI-powered tools that allow users to generate personalised comic covers and comic pages ("Comics") based on text and character descriptions. We use multiple AI providers—including OpenAI, Google Gemini (via fal.ai), and their underlying APIs—to generate content.

3. Eligibility & User Accounts

3.1 You must be 18 years old or older to use the Service.

3.2 Some features require creating an account. You are responsible for keeping your login credentials secure and for all activity under your account.

4. Payments & Refunds

4.1 Payments are processed securely through Stripe.

4.2 Refund Policy: We offer refunds within 5 business days of purchase if you have not used more than 5 generations. A "generation" is any attempt to create a comic or image using the Service, regardless of the final output quality.

4.3 Refund requests must be emailed to contact@mycomicgift.com.

4.4 We reserve the right to decline refunds where misuse or abuse is suspected.

5. Intellectual Property & Rights to Your Comics

5.1 Your Comics: You own the rights to the Comics generated for you. You may use them for personal or commercial purposes, including printing, gifting, merchandise, and social media.

5.2 Your Inputs: You are responsible for ensuring that any input you provide (names, images, text, likenesses) does not infringe the rights of others.

5.3 Our Technology: The website, platform, code, design, and AI integration remain our intellectual property or that of our providers.

6. Acceptable Use

You agree not to use the Service to create or share:

  • Illegal content
  • Harassing, hateful, or discriminatory content
  • Pornographic or sexually explicit content
  • Content involving minors
  • Deepfakes of real people without consent
  • Content infringing on any third-party intellectual property

We may suspend or terminate your account if you violate these terms.

7. AI-Generated Content Disclaimer

7.1 The Service uses generative AI and may produce unexpected, inaccurate, biased, or flawed content.

7.2 We do not guarantee that any generated content will meet your expectations or be error-free.

7.3 You are responsible for reviewing outputs before using them commercially.

7.4 The Service may be interrupted or unavailable due to model outages from our providers (OpenAI, Google Gemini, fal.ai).

8. Links to Third-Party Terms

Because the Service integrates fal.ai, OpenAI, and Google Gemini, your use of the Service is also subject to their policies:

9. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted under UK law, we are not liable for any indirect, incidental, or consequential damages, including:

  • Loss of profits
  • Loss of data
  • Loss of opportunities
  • Business interruption

Our maximum liability is limited to the amount you paid us in the 3 months prior to the claim.

10. Termination

We may suspend or terminate your access if you:

  • violate these Terms,
  • misuse the Service,
  • or engage in harmful behaviour.

11. Changes to the Service or Terms

We may update the Service or these Terms from time to time. If changes are significant, we will notify you via email or through the Service. Your continued use after updates means you accept the new Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved exclusively in the courts of England and Wales.
